According to a report in Bloomberg, Bayer AG has agreed to pay at least $110 million to settle about 500 lawsuits brought by claimants alleging that the Yaz/Yasmin/Ocella line of birth control pills caused blood clots and related complications.
The average settlement for these 500 claimants is approximately $220,000 per case. A Bayer spokesperson has confirmed that the company is settling some cases currently pending in the Yaz litigation, but did not confirm the aforementioned settlement figures.
Reportedly, more than 11,000 lawsuits have been brought against the makers of Yasmin and Yaz. Most of those cases are pending before Judge David Herndon in the Southern District of Illinois as part of a multi-district litigation (MDL). As previously mentioned on this blog, in January 2012 Judge Herndon ordered the parties to engage in mediation before the first "bellweather" trials were to proceed. Bloomber quotes products-liability law professor Carl Tobias as stating: "Sounds to me like mediation is paying off."
